Not only will this stand up in court. It already has. In April 2011, the Supreme Court upheld a very similar clause in AT&T user agreements.
In any other country in the world, this would be thrown out as unconscionable. But not in the US. We're special.

While arbitration clauses are clearly not desirable by consumers, this "article" is deceptive. It doesn't mention anywhere in the body of the article that the EULA still provides for arbitration. This is absolutely nothing new to contracts. Take a look at your next car rental contract. Yeah. Binding arbitration. It's been this way for many years.
Remember, no one is forcing you to accept the contract. I see no reason for the government to get involved.

No one is forcing you to accept the contract, but they aren't selling you the product until you surrender your right to take them to court. I'm sorry, but it's unconscionable for a company to do that to their customers and the sensible response as a consumer is to get pissed, not be like "well, ok. I know you're a business and so I can only expect you to care about making money so I guess I should throw my concerns for myself out the window. While I'm at it I'll also go against any government regulation of you as a company for the same reason." There are legitimate reasons to go to court against businesses and to agree to surrender that right as part of your payment for the product is not a smart idea and it's not something they should even be able to ask you to do. The government should get involved to stop that kind of business practice.
I swear, they could be poisoning the water supply and as long as it would be profitable for the company, a line of fools would pop their heads up to say "well, ok. As long as it keeps profit margins up and creates jobs. I'll just have to hope my family and I have immunity to the toxins." I'm sorry if this makes me seem a bit rude, but seriously, what benefit is it to you to have companies take away your rights to go to court in the event that you have a valid reason to do so?

It just sucks that this is coming from Sony. Lately I've been thinking of them as the least evil of the big 3. No region protection means a lot to me. Is this just for their online service, or does it include other parts of their goods/services?

To a small extent I have. Admitted, my only current gen console is a Wii. The other 2 had just been getting so evil lately that Sony had started to seem better by comparison. The 3DS and Wii's region locking have really been bothering me lately, and it seems like Microsoft would nickel and dime their consumers to hell if there was a penny to be made. After how solid the oXbox was I've had trouble making the transition to the 360. I find it absurd that people put up with that RRoD bull**** too.

After reading about Sony, can't say this really surprised me. Good thing I don't really like EA games.
There's always been some form of region locking, so it's not like this is really anything new. It was just easier back in the old cart days to unlock a console. Yeah, I know. The DS was really the first system I started importing for. In the case of the Wii, it's mostly about Xenoblade Chronicles. I didn't own a SNES back in the day, so this is really the first game I can think of that only Europe got (in english) that I REALLY want. I'd rather not hack my Wii again as I've seen a pretty bad failure rate with the console. If I do have to send it to Nintendo again they might not look past my modding if it happened so recently.
