Yeah, that's the general theory that applies to general EULA clauses, but this clause has already been tested in court with the AT&T decision. It was that court decision that made all the other companies start to put it in.

so the link in the original post isn't working. Well, its working but the site is currently pooped.

I rarely use ebay anymore because of their stupidity, but what does this mean for the average "buy one or two things a year" person? In layman's terms, please.

It would be unreasonable for a loan company to be expected to lend funds with no means to recoup losses if the borrower doesn't pay.

It's hard to construe some terms as reasonable. In my opinion, binding arbitration clauses fall in this category. Why does a company need this? No reason I can see other than to gain a bit of an advantage when it has problems with consumers.
