Re: Getting hit with a paypal claim
That is what I would do as well. I've had similar situations myself..superlarz wrote:Make sure they see the documents (web site) that said it is being sold "As is" and hopefully you have the tracking number. Make sure anything you write to communicate with the buyer sounds professional. Avoid any childish name calling or accusations. Try to be quick to answer any questions paypal asks and provide any information they ask for expeditiously.
I have filed 2 claims as a buyer, one I worked out with the seller, which was a significantly not as described, as he had listed the games as having the cases and manuals, but sent only disks. After several communications, he relented and sent the cases. The other was an NES systems that was never sent. The seller gave a fake tracking number and that was resolved quickly in my favor. It still took a while for the money to be recovered however.

I wouldn't lose sleep over it. Only a retard wouldn't get insurance on something as delicate as a laptop. And being sold in as is condition buried him. He doesn't stand a chance.
Re: Getting hit with a paypal claim
Thats what you would think, unfortunately, its decided by an arbitrator and paypal usually sides with the buyer. They put the burden of proof on the seller, and are sometimes really biased from what i've read. As long as you have a valid confirmation number and proof you were selling "as is" you should be ok, but the process can drag out. Make sure you are polite to both the buyer and anyone who contacts you from paypal. And get back to them quickly, or they will just assume you are at fault.corn619 wrote:I wouldn't lose sleep over it. Only a retard wouldn't get insurance on something as delicate as a laptop. Re: Getting hit with a paypal claim
wow. just wow. the nerve of some people.
it was sold as is... he bought it, if it doesn't work then tough luck.
you offered insurance... he declined, if it gets broken during shipping then its his fault and tough luck.
surely he can see that and he has no real case against you, his just hoping i guess.

Mozgus wrote:The problem with that advice is that the "quit it" portion of the process becomes much more complicated after the "hit it" maneuver has been completed. Much easier to "quit it" before all else.aaron wrote:hit it and quit it. i am certain mozgus is correct.
Re: Getting hit with a paypal claim
having won at least 2 claims with paypal i would say call them
from what u r saying you sound like you arent at fault
and the buyer is a bit shaddy or impatient

Re: Getting hit with a paypal claim
They answered their own questions. No you shouldnt do anything, and their skills at interpreting an item description isn't being questioned, since "AS IS" rules everything out. An opinion about a statement doesnt apply when you say AS-IS. As Is items means that the seller describes the item to the best of their ability, and if the buyer has any questions, they ask you. If they arent satisfied, they shouldnt buy it. If the item worked upon arrival, and is in the condition you described, with no insurance, then tough luck. Buyers beware. The guy was being honest tho, which sucks. He could have claimed the laptop did not work at all upon arrival, "skipping" the first day that they had the product and right to the part that it was malfunctioning.fox099 wrote:Buyer: Alright what do you want to do? nothing? even though you state as is your description of item leads people to believe that before you listed computer it was running fine. and in truth it could have been. the reason i bring up the shipping issue is the fact is I am not responsible for poor packaging on your part. I have recieved 3 laptops shipped from ebay and have never seen one so poorly packaged. you are talking microprocceors that would break if you droped the computer and to at least not have bubble wraped, well whatever. are you then saying that you will not return all my money or at least the 143.00?
It is up to the buyer to make sure they know what they are buying, and what they sign up for when buying a laptop without insurance.
They claimed your laptop was shipped in poor packaging, even though you have shipped previous laptops without incident. Then the buyer seems to go off in a tangent about expecting the laptop to be bubble wrapped, etc. This will not help them in their case.

Re: Getting hit with a paypal claim
I haven't used ebay in 2 years because they suck, but I've heard they've gotten really horrible. However if what fox099 says is true, as long as he is %100 truthful with paypal the proof is in the pudding and that can't be denied.superlarz wrote:Thats what you would think, unfortunately, its decided by an arbitrator and paypal usually sides with the buyer. Re: Getting hit with a paypal claim
They guy
a) ordered a laptop marked "as is" (something I stay away from)
b) turned down insurance
Seems like he was asking for it
I wouldn't worry too much.

Re: Getting hit with a paypal claim
Do Paypal even deal with claims other than the 'I never received my item' stuff?
I've had a ton of issues with Paypal as a seller. I sell intangible (digital delivery) goods though. It really screws me over because Paypal won't protect the seller unless you have a tracking number proving the item was shipped. So I've had scammers buy stuff, get their digital delivery, then chargeback. Nothing can be done
