I have an ethical dilemma, and I need the forum's advice.
In late December, I ordered some Atari 5200 games from an internet retailer. I had not received my order by mid-January, and I wrote a message to the retailer. I did not receive a response; so, I wrote another message a week later that gave the retailer a deadline for responding to me. Again, the retailer failed to respond; so, I opened a case with PayPal and requested a refund. Within a few hours of opening the case, I receive a message from the seller indicating that it has shipped the games. Given my history with the retailer (and my lack of options if I withdraw the claim), I decided to wait until I receive the games before withdrawing the claim.
I received the games today, and they look fine. A few hours before I received them, however, Paypal sides with me and refunds my money. Accordingly, I now have both the games and my money.
What are my obligations here? There is not a lot of money at stake - approximately $16 - and I feel guilty that I have both the games and money. I did have to plead with the retailer to send the games, however, and I did not like having to open a case to get them. Accordingly, I am not inclined to go to a lot of trouble to repay a retailer that did not meet my expectations. Accordingly, please let me know what you think I should do to resolve this situation.

I'd pay, personally. If you are keeping the merchandise, they did deliver after all...I know they suck, but it is theft IMO if you don't pay at this point.

Hmmm, so they sent the stuff, but only after you sent repeated messages and opened 'ebay litigation'?
Assuming what you ordered works, I'd send them $10, because you had to open a case in order for them to live up to their end of the deal. I have a feeling that if you hadn't, they would have continued ignoring your messages until you did so. That they sent the items so quickly after you opened a case, tells me that they were more interested in preserving their feedback than they were in sending what you bought.
I say send them the smaller sum and, if you can, leave appropriate feedback.

I think you should send them the money (in full) along with a short message telling them they need to get their act together if they expect to have repeat customers!

Be the better man and refund their money. Just because they were morally defunct doesn't mean you should be. Set a good example!

I am going to send the money back to them, but I have to figure out how to do it. (This was not an ebay purchase. I purchased directly from the retailer's website.) I think that I will just try gifting it through Paypal.
(My wife thinks that I should hold onto it for thirty days and wait for them to contact me three or four times before I send it back.
My "customer service" is a little bit better than that, however.)

I had a similar situation with an Amazon seller once. They were so flaky that they never responded when I tried to send money back. I just kept it.

Ah! I ordered from them once.
I bought a console.
I received an automated email almost immediately claiming that the store owner was "on vacation" or something similar, and that I would have to wait a month for shipment.
So I did. And when the system finally came it was poorly packed and received some damage in transit. Haven't ordered from them since. It's a shame because the site looks nice and the game selection is really solid.
