I don't understand a lot of the legal shit either. Either it hasn't been explained to me properly, there's more to it, or something. I am obviously not familiar with the terms of the particular trust or custodial account at issue, but trustees and custodians generally have broad authority to distribute and manage the assets held in a trust or custodial account. Moreover, assets held in testamentary trusts or custodial accounts typically do not become the sole property of the beneficiary when he or she turns 18. (For example - and if I recall correctly - the testamentary trust established by my will would distribute some of its assets to my children when they turn 25 and the remainder of the assets when they turn 30.) Accordingly - and although I am not familiar with the terms of the trust or custodial account at issue - it is unlikely that the stocks held in your grandfather's testamentary trust or custodial account became "yours" when you turned 18 (i.e., they likely remainded the trust or custodial account's property).
That said, trustees and custodians (such as your father) owe beneficiaries (such as you) fiduciary duties, and therefore, they cannot steal or waste the assets held in a trust or custodial account. Accordingly, if you suspect that your father is wasting or stealing assets from a trust or custodial account established for your benefit, you should consult with an attorney to assess your options (and learn more about the trust or custodial account at issue). Be warned, however, that fighting over trust assets can be difficult and (very) expensive, and depending on the amount held in the trust or custodial account, the best result in a fight over trust or custodial account assets is often a Phyrric victory.
