You aren't reading between the lines.

They're both jerks. Not justifying the murder, just stating you have to pick your battles. You never know who you are dealing with.

When I approach people who are illegally parked in handicap designated spots, I know for whatever reason the person could be armed and dangerous. It's a cautionary story.

Luke didn't justify the murder, not from what I read, at all.

The argument is whether this guy was being a "jerk" and whether the behavior was what we would classify as the behavior of a jerk.

The story as I understand it, the 71 yo whom was upset about the guy on his phone asked him to stop. The person refused. The 71 yo (also a retired office) went to theater management and asked them to intervene, which they apparently didn't.

He went back, the movie was going, and the guy was still on his phone, another argument ensued, the gun was pulled and the guy was shot.

No one I see is justifying the action - it's terrible. However, the reported behavior does sound frustrating and while I wouldn't have killed him, I would've done everything the old man did, short of the last thing he did.

^Correct. No justification for that action unless you are in fear for your life, which doesn't seem to be the case.

The eyewitness reports state that the older man, as Mike posted, asked him to turn it off, and the guy didn't. The older man went to management, who did nothing about it. When the older man returned to the theater the younger man heckled him about going to management, they started arguing, food was thrown, and then two were shot with one bullet.

This is coming from CNN, so who knows?

The Theater should have stepped in before it got out of hand. I really hate how portable devices intrude on others in a theater, a distracted driver looking at a GPS or one holding up (oops) delaying a line at the cash register. No reason to kill someone, but maybe break their text typing fingers one by one though.

That story reminded me of the opening scene in this movie:
