We do live together but all the stuff going on doesn't bother him since he is always at work. I on the other hand work from home and am in the process of packing to move so there is no escape. After 13 different stains in my ceiling and 2 bathroom floods i have had enough. The neighbors refuse to get jobs and move they were only supossed to stay 3 months that was a yr ago. and you can always take them to small claims court and force them to pay one way or another.

and you can always take them to small claims court and force them to pay one way or another.
We'll be out soon; just doing the final repairs/renovations on the new house.

If you want things to happen, you can't be lazy either. And "won't be bothered by legal formalities" is a load of shit. Grow a set and do something about your current living conditions. The situation as your wife/girlfriend/lover/whatever hasn't been happy for months by her own accord. That's far too long to not address the landlord personally.
From what has been said your landlord should owe you money for unsafe living conditions. Repairs and cleaning your old apartment should be tertiary at this point.
Go get 'em.

Tough love from Luke, but yeah, basically that.
Scan over your lease agreement about damages and responsibilities. Give your landlord a timeline (realistic) to investigate the damages and reimburse you. Let him know failure to meet certain steps will result with his name on the small claims docket as well. Be willing to pay the costs to file the claim(s) ($50-100 in most areas).
I'd suggest giving him 3-5 days to come and personally look at the damage. Then he can give you a 5-7 days to get estimates. Then give him maybe 2 weeks to provide reimbursement. Any failure on your parameters results in a small claims case being filed against him.
Side thought - do you have renter's insurance?
Also, if you have reported the damage prior and the situation wasn't addressed, i'd place a call to local law enforcement as well. Different cities / counties will have different laws on the books in regard to rental properties and obligations, but he may be in violation of local codes for sure, and possible local laws. Right now he thinks he's getting away with "they can't afford to pay for the damage"...don't let that be his answer. Call him on it.

Seriously, I would print out mjmjr's post and create a list of objectives to clear before moving out (or, ya know, make a check list of shit to do). You should bring the authorities into this, and you need to keep a log of your complaints for the record. Filing a complaint with the BBB would also be in your favor at this point as what your responsibility is right now is to establish a claim. When establishing your claim, make sure to take pictures, with a date. "This is how it was in April when we filed a complaint, this is what it looks like now in October". If your camera doesn't have a date feature, shell out a couple of quarters and take pictures with the day's newspaper.
Once you have your paperwork, I agree with mjmjr that you should file a claim, pay court expenses (which you can recoup), and take the landlord to court.

Smile: 2nd day of the Return to Ravnica prerelease, went Rakdos and opened the nuts. Went 3-0, then intentionally drew the last game both because the guy needed to book it to another prerelease and because I'd rather take 10 guaranteed packs then play for 14 if I win and 6 if I lose.
