Has Sony or any other company that has added these binding arbitration clauses with the ability to opt out released any numbers for how many people opt out compared to the who agree with the terms?

A few months ago. There was a big to-do here on the forums about it, and again with the Steam addition. Eventually I'm going to find someone who can tell the story of how their life was impacted by the clause, but I haven't found him yet.

I'm no lawyer, but my understanding of a lot of contracts is that they can put something in there, but it doesn't make it legal. If they went and put a "Ebay has the right to murder you" clause in there, it wouldn't actually give them the right to murder you.

I would imagine that any lawyer taking on a class action lawsuit would be able to work around such a thing. It would be one more hurdle to overcome though, and probably scares off some of the potential joiners of the suit. Which I'm sure is why they do it.
