Yeah, you can, if your flashcard supports it. You've just got to worry about Nintendo's bricking threat.

Yes, but even without going online with your 3DS to prevent the automated updates, remember that the 3DS requires firmware updates to play newer 3DS games and those updates prevent all known exploits to get flashcarts running on them, at least until the flashcart makers discover a work around. The cat and mouse game continues.
