Apparently, Bethesda thinks that the title "Scrolls" will confuse us poor simple minded consumers and we'll accidentally buy a card/board game instead of the open-world western RPG we were trying to buy.
Like Mojang, I hope that this is just lawyers being lawyers otherwise Bethesda are being massive dicks. Though really either way I think they're still being quite dickish.

Bethesda has always been touchy on the fact that they don't want anybody else using similar names to them, or using names of their games. IE, they are still in a lawsuit with another company who is attempting to make a Fallout MMO, while Bethesda is the copyright owner. I'm okay with them doing this, but this does seem a tad too harsh...

Does this mean I can't make a game called "Elder"? What about "The", if I use that in the title of my game won't people get confused, thinking it might be a game in "The Elder Scrolls" series?

I saw this all over twitter this morning. Everyone has been calling it "Skyrim" so I wouldn't be surprised if the non-average gamer even knows that it's elder scrolls. I'm sure it's just Bethesda being stupid. Didn't Minecraft sell it's 3 millionth copy today too?

Notch should change the name to "Younger Scrolls" to piss Bethesda off, then explain that he just wanted to "avoid market confusion."

Scrolls are too common of a word for Bethesda to win this. Just see e.g. the Dead Sea Scrolls Avi-Yonah's book Ancient Scrolls (2004).
