Just like with epilepsy warnings on every single game (whether said game has rapidly scrolling images, flashes, or not) companies will often make broad and over exaggerated claims of possible negative side effects to using their products as a precautionary measure.
It's cheaper to add those 3 kb of code than deal with a small chance of litigation down the road. It's also cheaper than examining the exact extent of the issue, which you know Nintendo never did or there would be official lists of games that do not work correctly. Nintendo also correctly assumes that 99.9% of the population will ignore said warnings.

Looking around, I've seen mention of Rampart, Xenon 2, and Warlocked having some issues (playable, but with graphics or sound issues).

In case your GB player comes with no manual here's an interesting tidbit I didn't know until I got one with a manual: You can hold down buttons on the controller to select different palettes/color schemes for original GB games.
Here is an FAQ on the palette button codes, which work on handheld GBAs and SPs too. Holding Left and B makes the original GB games black and white like they were originally.

you can download the manual for the GBP from Nintendo's website. I believe all GBA, GCN, DS, 3DS, and Wii related hardware manuals are all pdfed on their website.
