Those sites have nothing to do with real game business.

They didn't pay for the making of the games that they offer.

Which is exactly my point. Nintendo doesn't have to make a game, they just have to take a file and put it somewhere else.

ROMNation and CoolROM are just slapping ROM files on a server. Nintendo would have to code an emulator to have Virtual Boy games on the Virtual Console. Not the same thing.

Wouldn't the 3DS need an update as well? Or will it need software updates?

iirc VC games each have their own custom emulator. That alone brings up dev costs, and I'm sure there's lots of legal bs with licensing etc. I wouldn't be surprised if the majority of what goes into releasing those games is legal.
