They lost because they decided not to contest to Sony, they couldn't afford to fight the lawsuit so they just complied. Even if they had decided to contest it, Sony would have won anyway through pure legal muscle. Hey, if they can make something illegal in a country where it's not illegal (IE Australia where modchips are legal, but just because Sony cries to mommy, makes the PSJailbreak and it's clones illegal) then it's not much of a stretch of the imagination for Sony to win at any cost. They have the money to throw around. Sadly, Lik-Sang didn't.

This is at the dev's discretion, not Sony's. More than likely a lot of devs were getting pretty ticked at loss of profitability between regions or in divisions.

In the end it most likely won't affect any of the niche titles that importers truly care about.

Actually 90% of all western devs keep their games region free except for when it's getting a foreign release in the same time period or shortly soon after.

The biggest problem is the Japanese developers. Call me crazy but an incredibly large portion of Japanese developers are stuck up anti-foreign snobs (though this is actually a popular Japanese way of thinking as of late to hate anything non-Japan). It doesn't cost them anything extra to go region free on games, but they lock them on purpose to "protect our profitability and investment" or because "other regions aren't ready for something like this yet". like for example CAVE and the Mushihimesama and ESPagaluda II region free thing. Those two games alone thanks to them being region free have moved about half of the units of all their other games combined. Yet they stated they weren't gonna keep the rest region free because it was an "experiment" and they were expecting better sales.

In other words, complete bullshit.

Yup and that's what I'm afraid of is the fact that the popular Japanese titles that are never imported are going to get locked... Hopefully this only happens to a few titles, but I'll see it when I believe it..

It's Sony who put this in. It wasn't there before. It's been added since 3.30, it just wasn't useable by devs. Yes they can choose not to use it, but why would they? The fact is, Sony are the enabler here, it's not that devs suddenly had a change of heart. They couldn't region lock before, now they can. Just means more bad news to pile on top of bad news for Sony customers. I'm just glad I have absolutely no need to give Sony my money anymore. Seriously, do Sony want customers or just blind retarded fanboys? You'd have to be the latter to put up with this kind of crap.

Besides the PS3 scene will enable multi region games anyway. It's only a matter of time.
