That sounds like it's just how the seller listed the item. Just look here, there is used and new copies listed. There's a decent handful of sellers that give good descriptions of their item.

I'm trying to go used, get it for super cheap since I'm kind of in a pinch but want this game. Would you trust BrokeCollegeKid24? He's a new seller, but he has almost no info about himself.

I bought my copy on direct2drive.com, and it worked great for me. Their "GOTY" edition actually includes the main game and expansions on seperate installers, so I've never had an issue with it. And it's DRM free to boot.
If I'm not mistaken, Fallout 3 uses a Securom online activation check when you first install, so it's technically not DRM free, though it is a less invasive DRM than some other forms.

You definitely can get a good deal on this game at D2D or Steam though, and I'm sure it will hit an even lower price point around Christmas time if you wait a few months.
