Pirates got banned. Pirates think this is wrong. Pirates now suing Microsoft. They believe it was wrong to do, because it was done right before the release of Modern Warfare 2 - obviously, Microsoft planned this as a way to force people to re-buy their Xbox 360s so that they could play MW2.
Hilarious. Any pirate with a clue would know to not take their modded systems online. Now they're demanding money? You do know Microsoft has enough money to hire Jesus as their lawyer, right? And he'd win, too. He's Jewish.

Yeah, if this was a class action lawsuit by all the people who had 3rd party accessories for the 360 that got banned, I'd be in total support.

I'm not defending the pirates by any means, but I was always under the impression that modding a console wasn't illegal, since you own it once you buy it. I always thought that playing the pirated games was the illegal part... Maybe someone knows what part is the illegal part?

All this just seems like way too much effort for people who did something they knew was wrong in the first place. My 360 got banned about a week ago (yes, it was modded) and I knew that MS got me. No reason to get mad at them or join a class action against them.
Just sell the modded console, take the hit, and buy one of the million used/refurb consoles on the market.

It's because when you mod it and go online you're violating the TOS. Circumventing an effective copy protection device is illegal in the US under the DMCA. Sucks, but that's the way it is.
I agree with the general consensus here. Mod your console, don't take it online. If you do take it online, don't expect them to let you stay. However, Microsoft also disabled people's hard disks too. THAT is what they should be suing about. Kicking someone off your network is entirely within your rights. Damaging their hardware is not.

Funny, I've been using a modified Xbox for a year or two and I haven't been banned! Provided the only way I play "Pirated" games is through Xlink-kai. Hell I don't even use XBL anymore, It costs too much.
