Here's the funny thing about Gamestop: They sometimes sell brand new games as used. Why should they do this? I can tell you what a gamestop manager once told me. Take this as a grain of salt because it's third hand info at this point.
Corporate is reticant to sell new games for below the MSRP, but if they mark the game "used" they can sell it at a lower price.

Basically what I was told at Toy's R Us while I was working there last Christmas was they were not permitted to price or publicize deals for products below a certain price point. If companies caught them doing so they could pull their products from the store and even possibly sue the company.

Game Stop is probably in the same boat, but they can just unseal the games and sell them as used to get around it.

Good point I didn't think about them getting in trouble for going under retail. I was told some games get converted from new to used too, guessing when they don't sell well. Which can be nice getting a game in new condition, still though opening their only new copies for display doesn't constitute new anymore imo I hate that they do that.

Lately the shelves have been filled with nothing but generic cases too, places are starting to look like glorified flea markets with high prices. Guaranteed people just go there to get a case and manual for their game and just return it anymore.

It works both ways though at Gamestop. Lest we forget the $80 new but unsealed Xenoblade and Metriod Prime Trilogy releases for Wii. The normal rule is to go under as some stores do, or after a period they just clearance things as well like you see at Target. Some stores though will get permission to do sales under, or they eat the loss to get people in the door as well but I'd think that more uncommon.

Well folks I'm about to join the ranks of the evil corporation. Starting October 18th I'm a new seasonal employee. It's a second job for me, essentially just for fun yes I said for fun and of course the discount plus I have friends that work there, and I'll be working 1-2 days and 4-8 hours a week. The only sort of holiday I need to work though is Black Friday so that's nice. I haven't worked retail in almost 20 years so it should be interesting.

Black Friday will be a nightmare if your in a smaller store. When I was working last season at a freaking walmart sized Toy's R Us and the deals were pretty sucky overall we were still packed to the gills with people willing to kill each for $2-3 off of stuff most of which was so poorly constructed that it wasn't worth $2-3 to begin with :P.

I pitied the fools in the 15' x 60' game stop in the mall those poor bastards couldn't even move since their registers are in the middle of their store leaving only enough room for 2-3 people before you hit the wall :P.

Now that you mention it didn't modman say something back in the day about GS checking game forums and dealing out penalties and terminations? My memory is kind of fuzzy.
